Welcome, and thank you for your interest in SnapnSave (Pty) Ltd. (“SnapnSave”).
If you are not eligible, or do not agree to all of the Terms, then please do not use the Service.
Unless a contrary intention clearly appears, the following terms shall have the following meanings assigned to
them and cognate expressions shall have corresponding meanings, namely –
“Wallet Balance” refers to the accumulated Cash Back available in Your SnapnSave Wallet;
“Confidential Information” means all information and data of whatsoever nature (including the Intellectual Property), whether tangible, intangible, oral or in writing and in any format or medium that is obtained or learned by, disclosed to, or comes to the knowledge of You from SnapnSave during the course of or arising out of this agreement, by whatsoever means, which by its nature or content is or ought reasonably to be identifiable as confidential or proprietary to SnapnSave, or which is provided or disclosed in confidence;
“Cash Back” refers to monies that accrue to your SnapnSave Wallet when You complete a Valid Snap;
“Valid Snap” means a till slip or invoice that You uploaded to Your SnapnSave User Account and that SnapnSave has confirmed as being accurate and valid and where such slip or invoice contains details of Booked Offers that were purchased in the required time period for when that Offer is valid and where You indicated that You wish to claim
Cash Back Refunds linked to such Offer when you uploaded your till slip or invoice to Your SnapnSave Account.;
“Booked Offers” refer to Offers that You have indicated you wish to claim by clicking the book button on that Offer on the SnapnSave Platforms;
“Documentation” means integrated electronic help published by SnapnSave, describing Software’s functionality and intended operation;
“Double Cash Back” means that You receive double the value of Cash Back Refund linked to an Offer when you upload a Valid Slip to your SnapnSave User Account;
“EFT Transfer” means an electronic bank fund transfer made from Your SnapnSave Wallet to a bank account that You specify on the SnapnSave Platforms;
“Intellectual Property” means, collectively, patents, copyright, trademarks, designs, models, Know-How, inventions, trade and business secrets and any other type of intellectual property (whether registered or unregistered including applications for and rights to obtain, use or for the protection of same) which are used or held (currently or
not) in connection with SnapnSave’s business;
“Know-How” means: all ideas, designs, documents, diagrams, information, devices, technical and scientific data, secret and other processes and methods used in connection with SnapnSave’s business; all available information regarding marketing and promotion of SnapnSave’s products and services; and, all and any modifications or improvements to any of them which do not constitute entirely new products or services;
“Mobile Device” means a single mobile phone or other mobile device with a central processing unit capable of executing instructions from a software program, and which is owned or leased by You and on which the Software is installed;
“Merchant” means a provider with whom SnapnSave has entered into an agreement for the provision of products and/or services to You, for the purpose of benefitting from and making use of the SnapnSave Platforms or SnapnSave Services;
“Multiple Coupon Offer” means a Offer listed on the SnapnSave Platforms that entitles a User to redeem or claim the Offer more than once. The extent to which the User can claim or redeem the Offer will be listed on the SnapnSave Platform in the terms and conditions specific to that Offer;
“SnapnSave Wallet” refers to store value facility where Cash Back is held and where a User can withdraw or transfer any Wallet Balance;
“Offer” means a voucher listed on the SnapnSave Platform that entitles a SnapnSave User to a Cash Back Refund on a particular product or service should they adhere to the terms and conditions of the voucher and complete a Valid Snap
“Claimed Cash Back Offer” refers to an Offer on a Valid Snap
“Cash Back Refund” refers to rand amount in relation to an Offer
“Promo Code” relates to a code received from any third party which if applied when You create a SnapnSave User Account will earn you and/or the third party a specific rand value that will be credited tow Your SnapnSave Wallet should you submit a Valid Snap;
“Notify Me” means the process of requesting to book a Offer that that has already been fully booked by other Users so that when that Offer becomes available to book again, that the Offer is automatically booked for that User and the User is notified thereof;
“SnapnSave” “we” or “us” means SnapnSave (Pty) Ltd (reg. no. 2014/094030/07) a company duly registered and incorporated in South Africa with limited liability, and whose principal place of business is stated in section 18 of this document;
“Snapper Ranking” means the loyalty rewards structure for SnapnSave for Users to be rewarded for uploading a certain number of Valid Snaps and being rewarded for a certain number of Claimed Cash Back Offers;
“Software” means the object code of and Documentation for ‘SnapnSave mobile application’;
“Specific Offers” relates to Offers that are only available to specific Users and not to all the Users.
“Withdraw” relates to when Users transfer funds from their SnapnSave Wallet to their bank account through an EFT Transfers or to their WeChat Wallet or any other designated account shown on the SnapnSave Platform;
“The SnapnSave Service(s)” “Service(s)” means all services offered by SnapnSave as shown and delivered on the SnapnSave Platforms and other related features or services;
“You” “Your” means the person who visits the SnapnSave Platforms and or uses the SnapnSave Services and or clicks ‘I Accept’ when signing up for a SnapnSave User Account. Alternatively, if the person who clicks ‘I Accept’ does so on behalf of any legal entity, then “You” means the legal entity on whose behalf ‘I Accept’ is clicked, and the person who clicks ‘I Accept’ warrants, by doing so, that he has taken or caused to be taken all steps, actions and corporate or executive proceedings necessary to cause this agreement to be binding on that legal entity;
“SnapnSave Platform(s)” means the SnapnSave Android and iOS app, it’s website and mobi site at http://www.snapnsave.co.za or any digital platform or solution where SnapnSave offers its services;
“SnapnSave User Account” means an account that is created by a User when completing the sign up process on any of the SnapnSave Platforms;
“User(s)” means someone who has created a SnapnSave User Account or someone who use the SnapnSave Services or accesses the SnapnSave Platforms;
ACCEPTANCE OF TERMS AND CONDITIONS AND UPDATES THERETO
Should any Terms and Conditions posted or displayed at other places be in conflict with terms posted at http://www.snapnsave.co.za the Terms and conditions displayed at http://www.snapnsave.co.za will considered to be the latest accurate version of the Terms and Conditions. Any updates to the Terms and Conditions will be effective upon them being displayed at http://www.snapnsave.co.za. You or any Users continued use of the SnapnSave Platforms and Services will constitute your acceptance of the Terms and Conditions as revised.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or any other provision. These Terms and Conditions set forth the entire understanding and agreement between You and SnapnSave with respect to the subject matter hereof.
THE SNAPNSAVE SERVICE
As part of our service, SnapnSave owns or controls, and provides access to the SnapnSave Platforms and agrees
to provide You with the SnapnSave Services that SnapnSave may decide to offer, subject to these Terms and
USE OF SERVICE
Registering your account:
To be able to benefit from all the SnapnSave Services, You will be required to register for a SnapnSave User Account. To register for a SnapnSave User Account You will need to provide Your cell phone number. I addition you will need to provide further personal information, as displayed on the SnapnSave Platforms, by linking to Your Facebook account, or by manually entering information.
By registering for a SnapnSave User Account, You will be able to access the full functionality and breadth of Offers, that we and our Merchants make available from time to time.
When registering for a SnapnSave User Account, You agree to provide only accurate and complete information and to keep this information up-to-date. By providing SnapnSave with Your personal information and by opting in to communications, You give SnapnSave permission to send You information regarding its Service via cellular phone, and email.
SnapnSave displays through the SnapnSave Platforms and SnapnSave Service Offers. A User will be required to book an Offer to have a right to claim the benefits of the Offer. To claim benefits displayed on each Offer an User will need to complete a Valid Snap. Upon completion of a Valid Snap a User will be able to view Their Wallet Balance and withdraw funds as indicated in these Terms and Conditions.
Offer Terms and Conditions (“Additional Terms”):
Each Offer may be subject to Additional Terms. At any time and in SnapnSave’s sole discretion, SnapnSave may: (i) determine whether or not You are eligible to redeem an Offer; (ii) determine whether or not You have submitted a Valid Slip pertaining to that Booked Offer; or (iii) adjust Your Wallet Balance to retrospectively adjust for instances where SnapnSave previously a Valid Till Slip.
Pending approval till slips:
On submitting a till slip via the SnapnSave Platforms the uploaded till slip will bemarked as ‘pending approval’ until such time as SnapnSave has confirmed the uploaded till slip is a Valid Till Slip.
Until such time as SnapnSave indicates that the uploaded till slip is a Valid Till the User shall have no claim whatsoever for the value of Booked Offers that could or are reflected on the uploaded till slip.
If You book a Multiple Coupon Offer on the SnapnSave Platforms, your maximum number of Offers you may claim relating to that Multiple Coupon Offer will be booked automatically.
If the offer stipulates that it is a Multiple Coupon Offer, then the more than one unit of that Offer will be able to be booked depending on the stipulated maximum number of units. If not stipulated as a Multiple Coupon Offer, the Offer will only be able to be claimed and booked once.
For all Multiple Coupon Offers, You may book the specific offer up to the maximum units available, more than once until the maximum units for that offer have been depleted. The Offers available per Multiple Coupon Offer are depleted after uploading a till slips and where the User has indicated they wish to claim that Multiple Offer until such time as that till slip is confirmed as a Valid Till Slip.
For example- A Multiple Coupon Offer for Product X can be used 5 times by a User. You book the Multiple Coupon Offer which automatically books the 5 Offer. You purchase 3 products that entitle you to claim the Offer. You upload the till slip on the SnapnSave Platform and indicate you wish to claim the Multiple Coupon Offer. On upload of your till slip You will not be able to further claim the other 2 Offers until the till slip is confirmed as a Valid Till Slip. On confirmation of this You will receive Cash Back into your SnapnSave Wallet for 3 of the Offers. You will then be able to book and claim 2 more Offers under the Multiple Coupon Offer.
SnapnSave reserve the right to display Specific Offers. A User who is not entitled to that Specific Offer will not be able to view or book and have no claim to any Specific Offer to which they are not linked.
An Offer on the SnapnSave Platform may require a User to perform a specific Action when booking an Offer. A User will not be able to book and claim the Offer unless the required action is complete. The required action will be displayed to the User on the SnapnSave Platforms. Some of the types of actions and engagement are as follows (i) Watch a Video: A User will need to watch a video until the book icon will appear to be able click thereon to book that specific Offer (ii) Unlock Code: You will need to enter a code received from another source in order to book the Offer. (iii) Share on Social Media: A User will need to share details about the Offer through Your social media channels such as Facebook or Twitter in order to book that specific Offer (iii) Survey: A User will need to complete a survey in order to book that specific Offer (iv) Specific Questions: A User will be required to answer a question or provide personal details, as well as agree to share your personal data and answers provided with third parties by in order to be able to book that specific Offer. If You select agree to this by clicking accept on the Platform then You give full consent or SnapnSave to provide your personal information, answers for that question and any other details to third parties. SnapnSave cannot be held liable for any distribution of your personal information.
Uploads of Till slips and Invoices:
A User can upload a till slip or invoice using the SnapnSave Platforms. The Service shall determine whether the till slip will be processed as a Valid Till Slip (SUCCESS) or not (FAILURE). The validity of the till slips is to be measured using SnapnSave’s internal testing procedures, which may be amended at any time. If a till slip is marked as a FAILURE, the reason for the failure will be communicated to the user using either email and/or SMS or on the SnapnSave Platforms. If a user wishes to find out more information about the failed validation, they may contact SnapnSave using the email address, hello@SnapnSave.co.za. If a till slip is marked as a SUCCESS, then the Service will allocate the respective Cash Back to Your SnapnSave Wallet.
Wallet & Withdrawals:
All Cash Back will be held in a Users SnapnSave Wallet. A User can withdraw their Wallet Balance provided the minimum requirements to withdraw the Wallet Balance amount have been met (“Minimum Withdrawal Requirements”). The Minimum Withdrawal Requirements will be displayed to a User when they hit the cash out button in the User’s SnapnSave Wallet and may vary from time to time or user. Should the minimum Withdrawal Requirements be met the User will be able to withdraw funds by transfer the Wallet Balance to a WeChat Wallet or EFT the Wallet Balance to a designated bank account or transfer the Wallet Balance through other services as is shown on the SnapnSave Platforms.
A Users Wallet Balance will increase for the following events: (i) When a User submits a Valid Till Slip, the Cash Back amount relating to each specific Booked Offer that a User has indicated that they wish to claim when uploading the till
slip will be transferred into the Users Wallet Balance (ii) When SnapnSave manually credits a Users Wallet Balance for any reason that SnapnSave deems necessary (iii) When a Users earns any Snapper Ranking or Loyalty Rewards (iv) When a User earns monies from a Promo Code (v) Any other reason as will be displayed on the SnapnSave Platforms
SnapnSave is not liable for any unauthorised EFT Transfer payments made by You due to Your negligence, theft of Your cell phone, You entering incorrect bank account details, login details not kept safe by You or any other manner of unauthorised EFT Transfers.
A User can transfer funds from their SnapnSave Wallet under the following terms:
(i) Minimum Withdrawal Requirements: A User has met the Minimum Withdrawal Requirements
(ii) Timing: EFT Transfers will only be made once a week on a Friday so funds should reflect in your bank account by 8pm each Friday evening. If payments are not reflected by this time each Friday, there is a chance that your account details are incorrect and the EFT Transfer has been unsuccessful. Only cash out requests for EFT Transfers requested by Users between the previous Friday from 00h00 until the current Thursday at 23h59 will be processed in the weekly payments each Friday. If cash out is selected after 23h59 on Thursday, then they will be allocated to the following week’s EFT payment batch. In the case when Friday is on a public holiday, then the EFT payment batch for that week ending the Thursday at 23h59 will not be loaded on the Friday but rather on the following working day after that Friday.
(iii) Bank charge: EFT Transfers will attract a bank charge of R2.50 for each transaction and this cost will be deducted from your Wallet balance and be indicated under Wallet History as “EFT Bank Fee”.
(iv) Bank account details: It is the responsibility of the User, to ensure that all bank account details are accurate and valid when entering them into the SnapnSave Platform. If a User wishes to edit bank details, they are able to do so but will need to insert your old bank account number before the new bank account number can be entered, in order for the change to be effective. You are able to add additional bank accounts for friends or family members should you so wish. If you are not sure if the bank details are added, you will see the logo of the bank you recently added and the word, “Linked to EFT” next to it. This will indicate that the bank details are added on your profile.
(v) Verification of bank account details: Once You have clicked on the Cash out button in your SnapnSave Wallet and selected the Activate button to the right of EFT Transfer thereafter, you will be able to enter your bank details, and those bank details will be verified for accuracy. If your bank account details are verified unsuccessfully, then You will be notified via email to update your bank details on Your SnapnSave profile. No EFT Transfers will be actionable if your bank details have not been verified successfully. Unsuccessful EFT Transfers. If the EFT Transfer is unsuccessful due to incorrect or invalid bank details entered by You, then a bank charge of R2.50 will be deducted off your SnapnSave Wallet and will be indicated on your Wallet History as “Bounced EFT”.
(vi) Security and Confidentiality: All bank details will be kept confidential and safely secured in the SnapnSave platform and we commit not to distributing these bank details to any party for any other purposes other than to cash out Your SnapnSave Wallet.
(vii) Banks available for EFT Transfer: Currently You may only add bank account details relating to the following 7 South African banks in terms of using the EFT Transfer function on SnapnSave platform – ABSA; Nedbank; FNB; Standard Bank; African Bank; Capitec; Investec.
(viii) Maximum Cash Out: The maximum cash out amount per EFT Transfer transaction is R3000 each. A User may only withdraw up to a maximum of R3000 per week.
(ix) EFT Notifications: Users will receive the following notifications when doing an EFT Transfer on the Platforms: All Users which have unsuccessful EFT Transfers will be notified via email that their EFT Transfer was unsuccessful and that they need to update their bank details or add a valid bank account before trying to Cash Out funds from their SnapnSave Wallet using EFT Transfer again; A User who has added new bank account details to their SnapnSave profile,
will be notified via email that a bank account has been linked to their profile.
The lifetime earnings balance in the SnapnSave Wallet of the Service is a total of all past Cash Back earned by the User. This balance does not reflect the amount that can be withdrawn.
A User can utilise and benefit from Promo Codes under the following terms:
(i) Promo Code use and benefit: Users may enter a Promo Code when registering their account on the SnapnSave Platforms by inserting the Promo Code in the field “Got Promo Code?”. This promo code will then either Credit a specific rand value associated with that promo code to the Users SnapnSave Wallet or, Link a User to a ‘’friend’ who provided the User with their own specific Promo Code (“Referral Code”) so that when the User claims a Valid Snap the person who provided the Referral Code will receive R5 for each of the first two Valid Slips submitted (R10 in total) by the User.
(ii) Promo Codes can only be redeemed online using the SnapnSave platform. Promo Codes will be void where prohibited by law. Only one (1) promo code may be redeemed per user account/ per promotion. Promo codes cannot be used in combination with other promo codes. Promo codes cannot be applied after a user is already registered with SnapnSave.
(iii) Transfer of funds received from Promo Codes: SnapnSave reserve the right to transfer any monies earned from a Promo Code out of a Users Wallet.
(iv) Expiry Dates of Promo Codes: SnapnSave reserves the right to expire Promo Codes without notification
(v) Protection of Promo Code: SnapnSave issues each User a unique Promo Code to issue to other Users to be used as a Referral Code. You are responsible for the security of your own promo code number. We will not replace any amount from your Promo Code that has been used by another party.
(v) Right to change terms and cancel Promo Code: SnapnSave reserves the right, without further notice to the holders of the promo codes, to modify the terms and conditions for use of the promo codes, or to suspend or cancel the promo code program in whole or in part, right to decline to award promo code credits, demand repayment of promo code values credited, or take other remedial actions.
Notify Me Offers:
Offers may have a limit as to the number of Users who can claim that Offer. To reserve the right to claim an Offer a User will need to book an Offer. When Offers have been booked out by other Users, You can request to be put in the queue should the ability to claim that Offer arise again. To makes this request a User can hit the “Notify Me” button on the SnapnSave Platforms in relation to that specific Offer. Once a User has hit that button and then the ability to claim that Offer arises SnapnSave will automatically book that Offer and send You a notification to advise as such, provided that you have downloaded the SnapnSave App. Users who have not downloaded the App will not receive a notification.
By hitting the ‘Notify Me’ button does not indicate that You will be guaranteed to have a claim to book the Offer in
the future. You will simply be placed in a queue of Users who have requested the same. The ability to claim the
Offer will be granted on a sequential “First-In-First-Out” system based on the time when a User hit the “Notify Me”
Double Cash Back:
For selected till slips that You submitted, SnapnSave reserves the right to credit your SnapnSave Wallet with double the value of Cash Back.
Snapper Ranking Loyalty Rewards:
Snapper Ranking is a loyalty rewards structure implemented from 1 July 2017 and ended on 31 March 2020.
This program rewards SnapnSave Users with cashback for snapping a certain number of Offers that were approved.
Users will not be credited for any Offers redeemed before 1 July 2017 or for any till slips uploaded on or after 31 March 2020.
Users will earn R5 credited to their SnapnSave Wallet on their 11th Offer that is approved. They will earn additional R5 for every 10th Offer approved thereafter i.e. 21st, 31st, 41st etc. up to a maximum of 360 offers.
SnapnSave reserves the right to not pay out any monies under the Snapper Ranking Loyalty Rewards or credit Users with additional monies as is required.
After 31 March a User will not have any claim whatsoever from the Snapper Ranking Loyalty Reward.
The R5 credit earned will be able to be viewed in Your SnapnSave Wallet page and the wording “Trophy” will be used next to each R5.
There is a monthly – and a lifetime leader board displayed on the SnapnSave Platforms where all User names will be displayed for You to see where you are positioned compared to all the other SnapnSave Users.
Your Snapper Ranking cannot be modified by You and all Snapping Ranking data, trophies, leader board
and Snapper Rankings measurements are calculated automatically by SnapnSave.
By using the SnapnSave platform, You give full consent that you are willing to share Your full name and surname, Your Snapper Ranking and Snapper Ranking leader board position on the Lifetime Leader board and Monthly Leader board on the SnapnSave platform on the Snapper Ranking page.
Super Snapper is a rewards program implemented on 1 April 2020.
This reward program rewards Snappers who have had 10 or more Offers approved in a calendar month. The time for determining an approved Offer in a calendar month will be determined by the date the till slip is uploaded that contains the Offers that is approved.
All Users who meet the 10 Offer criteria in a Calendar month will be marked as a Super Snapper in the next calendar month and will have Specific Offers that they will be able to view and claim. These Specific Offers will be loaded on the 7th of a Calendar month and will be valid until the 30th of that calendar month.
SnapnSave reserves the right to cancel, or modify any aspect of the Super Snapper reward structure without the consent of the users. SnapnSave cannot guarantee that Specific Offers will be available to all Super Snapper Users.
Right to Terminate:
SnapnSave reserves the right in its sole discretion to terminate or restrict Your use of the SnapnSave Platforms or SnapnSave Service, without notice, for any or no reason whatsoever.
Closing of a SnapnSave User Account by a User:
A User/ You may close Your SnapnSave User Account by emailing firstname.lastname@example.org requesting for Your account to be closed. SnapnSave will then contact you via email to confirm Your request and to confirm Your contact details. On the date and time of You sending an email confirming this information Your SnapnSave User Account will be closed by SnapnSave. Once a SnapnSave User Account is closed You will have no claim whatsoever to Your SnapnSave Wallet Balance. It is Your responsibility to withdraw funds in Your SnapnSave Wallet prior to closing you SnapnSave User
Account. Should a User wish to withdraw funds from their SnapnSave Wallet in order to close their Account they will still need to comply with the Minimum Withdrawal Requirements. A User will have no claim to funds that do not meet the Minimum Withdrawal Requirements.
Closing of a SnapnSave User Account by SnapnSave:
SnapnSave reserves the right to close a SnapnSave User Account in the following cases:
(i) A User is in breach of these Terms & Conditions: SnapnSave will close a SnapnSave Users Account should SnapnSave suspect that a User is in breach of these Terms & Conditions. SnapnSave will notify the User who is suspected to be in breach of the Terms & Conditions within 7 days of closing the SnapnSave User Account of the fact that Their SnapnSave User Account has been closed and provide details of the reason for closure (“Closure Notice”). SnapnSave will provide Closure Notice by emailing the SnapnSave User. Should no email address be provided by the User on their SnapnSave Account, SnapnSave will attempt to SMS the Closure Notice to the User. The User will have 14 days from the date when Closure Notice was sent to contact SnapnSave to dispute the Closure (“Dispute Notice”). SnapnSave will review the Dispute Notice and then reserves the right to activate that Users SnapnSave User Account. SnapnSave will have the sole discretion and decision to reactivate the SnapnSave User Account. The User will have no remedies should SnapnSave decide not to reactivate a SnapnSave User Account or should SnapnSave not comply with notifications as outlined. A User will have no claim whatsoever to their SnapnSave Wallet Balance from the date that SnapnSave suspects a User to be in breach of these Terms & Condition and closes the SnapnSave User Account. If SnapnSave reactivates a SnapnSave User Account after it was closed the Users full SnapnSave Wallet Balance will be available to the User as was the balance reflected immediately prior to the SnapnSave User Account being closed due to suspicion of breach.
(ii) A User who is been inactive: SnapnSave will close a SnapnSave User Account where a User has failed to submit a Valid Till Slip through the SnapnSave Platforms in any of the preceding 12 (twelve) calendar months. A User will have no claim whatsoever to their SnapnSave Wallet Balance from the date that SnapnSave closes the SnapnSave User Account due to a User not being active. SnapnSave reserves the right to reactivate a SnapnSave Users Account that was closed as a result of being inactive. If SnapnSave elects this right then the Users full SnapnSave Wallet Balance will be available to the User as was the balance reflected immediately prior to the SnapnSave User Account being closed due to the account being
(iii) Where SnapnSave is voluntarily wound down, SnapnSave will:
• Close all SnapnSave User Accounts, without notice, where a User has failed to submit a Valid Till Slip for 12 (twelve) calendar months prior to the date of when SnapnSave is wound down. A User will have no claim whatsoever to their SnapnSave Wallet Balance from the date that SnapnSave closes the SnapnSave User Account due to the SnapnSave User Account being inactive.
• Close all SnapnSave User Accounts, without notice, where a User has submitted a Valid Till Slip in the last 12 (twelve) months prior to the date when SnapnSave is wound down but the User does not meet the Wallet Balance does not meet the Minimum Withdrawal Requirements. This User will have no claim whatsoever on any funds in their SnapnSave User Account at date of closure.
• Include a notice, on the date that SnapnSave is Voluntarily is wound down on the SnapnSave website and application, where the User has submitted a Valid Till Slip in the 12 (twelve) months prior to the date when SnapnSave is wound down and has a Wallet Balance that meets the Minimum Withdrawal Requirements. These Users will have 5 (five) days from date of notice to withdraw any monies in their SnapnSave Wallet. After the notice date SnapnSave will close all SnapnSave User Accounts. A User will have no claim whatsoever once their SnapnSave User Account is closed.
(v) Where SnapnSave ceases to operate (including but not limited to liquidation, closer as a result of a force majeures or any other reason other than when SnapnSave is voluntarily wound down), SnapnSave will close all SnapnSave User Accounts on the date it ceases to operate, without notice. All Users who have their SnapnSave User Account closed as a result of the SnapnSave ceasing to operate will have no claim whatsoever to any funds in their SnapnSave Wallet Balance.
Certain content available through and used to operate the SnapnSave Platforms and the SnapnSave Service, including, without limitation, organization, graphics, text, images, audio, videos, designs, compilations, advertising copy, trademarks, logos, domain names, trade names, service marks and trade identities; any and all copyrightable material (including source and object code); and all other materials related to the SnapnSave Platforms and the SnapnSave Service (the “Content”) are protected by applicable copyrights and other proprietary (including, but not limited to, intellectual property) rights and are the property of SnapnSave, its parent, subsidiaries, affiliates, or its licensors.
Without limitation, this means that, except for the express limited grant of rights herein, You may not, directly or indirectly, sell, lease, publish, export, license, modify, copy, reverse engineer, create derivative works, reproduce, distribute or transmit the SnapnSave Service without SnapnSave’s prior express written permission. Any unauthorized use of the SnapnSave Service will terminate the limited license granted by us.
SnapnSave and other marks, graphics, logos, icons and service names related to the SnapnSave Service (the “Marks”) are registered and unregistered trademarks or trade dress of SnapnSave Inc. The Marks may not be used without SnapnSave’s prior express written permission. All other trademarks not owned by SnapnSave that appear in connection with the SnapnSave Service are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by SnapnSave.
Subject to Your strict compliance with these Terms and Conditions, SnapnSave grants You a limited, personal, non-exclusive, non-commercial, revocable, non-assignable and non-transferable license to download, view, use and/or play a single copy of the SnapnSave Platform (excluding source and object code), provided that You:
By creating a SnapnSave User Account and/or using the SnapnSave Service, You consent to receiving electronic communications and notices from SnapnSave. You agree that any notice, agreement, disclosure or other communications that we send to You electronically will satisfy any legal communication requirements, including that such communications be in writing. Notices from us will be considered delivered to You and effective when sent to the email address You provide on the SnapnSave Platforms or from which You otherwise email us. You may withdraw this authorization at any time upon written notice to SnapnSave to email@example.com
You agree not to upload, post, e-mail or otherwise send or transmit any material that contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the SnapnSave Platforms or SnapnSave Service.
You also agree not to interfere with the servers or networks connected to the SnapnSave Platforms or SnapnSave Service or to violate any of the procedures, policies or regulations of networks connected to the SnapnSave Platforms or SnapnSave Service, the terms of which are incorporated herein. You also agree that in Your use of the SnapnSave Platforms or SnapnSave Service You will not: (1) impersonate any other person or defame, injure, abuse, threaten or invade the privacy of others; (2) conduct Yourself in a vulgar, offensive, harassing or objectionable manner; (3) use the SnapnSave Platform or SnapnSave Service for any unlawful purpose; (4) post or otherwise submit material that is protected by copyright and other intellectual property rights of others or (5) use the SnapnSave Platforms or SnapnSave Service to obtain any Cash Back to which You are not entitled according to the terms of the Cash Back.
SnapnSave does not promote, recommend or condone use of the SnapnSave Platforms or SnapnSave Service during certain activities, such as automobile driving, where there is a significant risk of accident. You agree not to use the SnapnSave Platforms or SnapnSave Service during such activities.
Ny using the service you agree not to:
(i) submit to SnapnSave purchase information that is false, inaccurate, fabricated, counterfeited, tampered with, adjusted, or otherwise artificial or inauthentic for the purpose of seeking to redeem Offers with SnapnSave;
(ii) redeem, or attempt to redeem, SnapnSave Offers for products that have not actually been purchased and retained, or for products that have been purchased but returned to a store, following purchase;
(iii) upload receipts to SnapnSave that have already been uploaded by You or another user, for the purpose of earning credit from SnapnSave for purchasing products that You did not actually purchase;
(iv) upload receipts to SnapnSave that reflect purchases that took place more than forty eight (48) hours after the date on which the Offer is booked;
(iv) upload receipts to SnapnSave that reflect purchases that took place prior to the launch date of a retailer’s campaign and therefore prior to Your booking the Offer, except where expressly permitted in the Offer details;
(vi) attempt to obscure the date on a receipt, such as by purposefully uploading a receipt without any date shown or without any clearly legible date shown;
(vii) extract information from SnapnSave’s web or mobile applications for the purpose of using said information in conjunction with another service, web or mobile application;
(viii) rent, lease, loan, sell, resell, sublicense, distribute or otherwise transfer the licenses granted herein or any Materials (visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), products, software, services, and all other elements of the Service provided by SnapnSave).
(ix) post, upload, or distribute any defamatory, libellous, or inaccurate User Content or other content;
(x) post, upload, or distribute any User Content or other content that is unlawful or that a reasonable person could deem to be objectionable, profane, offensive, indecent, pornographic, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially or ethnically offensive, or otherwise inappropriate;
(xi) exploit or attempt to exploit SnapnSave’s referral bonus program by inviting Yourself to join SnapnSave using another account or invite others who share the same mobile device, in an effort to earn referral bonuses or credit(s);
(xii) make false or misleading claims about SnapnSave’s referral program or any other incentive program created by SnapnSave;
(xiii) impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the Service accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity, or content of information transmitted via the Service, or perform any other similar fraudulent activity;
(xiv) delete the copyright or other proprietary rights on the Service or any User Content;
(xv) make unsolicited offers, advertisements, proposals, or send junk mail or spam to other users of the Service. This includes, but is not limited to, unsolicited advertising, promotional materials, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures;
(xvi) use the Service for any illegal purpose, or in violation of any national law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy, or the collection, storage, transmission, or access of educational records;
(xvii) defame, harass, abuse, threaten or defraud users of the Service, or collect, or attempt to collect, personal information about users or third parties without their consent,
(xviii) use the Service for any commercial purpose other than the internal business purposes of maintaining and administering school records without our consent;
(xix) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Service or User Content, features that prevent or restrict use or copying of any content accessible through the Service, or features that enforce limitations on the use of the Service or User Content;
(xx) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Service or any part thereof (including any App), except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;
(xxi) modify, adapt, translate or create derivative works based upon the Service or any part thereof, except and only to the extent the foregoing restriction is expressly prohibited by applicable law; or
(xxii) intentionally interfere with or damage operation of the Service or any user’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.
Limitations on User Accounts:
A user may not create more than one (1) SnapnSave User Account.
Charges for Using the SnapnSave Service:
Unless otherwise indicated on the SnapnSave Platforms, SnapnSave provides the SnapnSave Platforms and SnapnSave Service to You free of charge. However, You are solely responsible for any charges related to your use of the SnapnSave Platforms or the SnapnSave Service, such as those imposed by Your wireless, internet or other applicable provider.
You will be solely responsible for any and all tax liability arising out of receipt of funds from using the SnapnSave Platform or SnapnSave Services.
Use of Information Submitted:
You agree that SnapnSave is free to use any comments, information or ideas contained in any communication You may send to SnapnSave or post or submit on the SnapnSave Platforms without compensation, acknowledgement or payment to You for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the SnapnSave Service or other products or services.

No Warranty & Liability Limit:
You agree that Your use of the SnapnSave Platforms or SnapnSave Service is entirely at Your own risk. SnapnSave provides access to and use of the SnapnSave Platforms and the SnapnSave Service “as is” and without any warranty or condition, whether express, implied or statutory. SnapnSave specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement, including without limitation any warranty for information, services, uninterrupted access, products provided through or in connection with the SnapnSave Platforms or SnapnSave Service, including without limitation the results obtained through the SnapnSave Platform or SnapnSave Service. Specifically, SnapnSave disclaims any and all warranties, including without limitation: (i) any warranties concerning the availability, accuracy or content of cash back, information, products or services related to the SnapnSave Platforms or the SnapnSave Service; and (ii) any warranties of title or warranties of merchantability or fitness for a particular purpose.
SnapnSave assumes no liability or responsibility for any errors or omissions related to the SnapnSave Platforms or SnapnSave Service; any failures, delays or interruptions related to the SnapnSave Platforms or SnapnSave Service; any losses or damages arising from the use of the SnapnSave Platforms or SnapnSave Service, including, without limitation, any damage to Your mobile device; or any conduct by users of the SnapnSave Platforms or the SnapnSave Service. We reserve the right to deliver the SnapnSave Platforms or SnapnSave Service in our sole and absolute discretion.
In no event shall SnapnSave, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to You for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the SnapnSave Platforms or the SnapnSave Service or these Terms and Conditions, on any theory of liability, and whether or not advised of the possibility of damage. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behaviour, negligence, or under any other cause of action. You specifically acknowledge that SnapnSave is not liable for the defamatory, offensive or illegal conduct of other customers or third-parties and that the risk of injury from the foregoing rests entirely with You. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
You agree that the aggregate liability entitled to You for any and all claims arising from or related to the use of the SnapnSave Platforms or SnapnSave Service is limited to R1500. The limitations of damages set forth above are fundamental elements of the basis of the bargain between SnapnSave and You.
You agree to indemnify and hold SnapnSave and its related companies, each of their respective shareholders, directors, officers, employees and agents, each retailer from which a purchase is made and any brand or manufacturer or Mechant whose product or service you purchase, harmless from and against any claim or third party claim or cause of action, including reasonable attorneys’ fees and court costs, arising, directly or indirectly, out of Your use of the SnapnSave Platforms or SnapnSave Service, Your breach of these Terms and Conditions, or Your violation of any law or the rights of any third party.
Disputes and Governing Law:
You agree that these Terms and Conditions or any claim, dispute or controversy (whether in contract, tort or otherwise, whether pre-existing, present or future, and including statutory, common law and equitable claims) between You and SnapnSave arising from or relating to these Terms and Conditions, their interpretation or breach, termination or validity, the relationships which result from these Terms and Conditions, the SnapnSave Platforms and the SnapnSave Service, SnapnSave advertising or any related transaction shall, to the maximum extent permitted by applicable law, be governed by the laws of the South Africa, without regard to its conflicts of laws rules.
Limitations of Actions:
Any claim or cause of action arising out of or related to Your use of the SnapnSave Service must be filed within six (6) months after the event that gave arose to such claim or cause of action, regardless of any statute or law to the contrary. In the event any such claim or cause of action is not filed within such six (6) months period, such claim or cause of action shall be forever barred.
Receipt of communication
SnapnSave may send marketing or other forms of notices to You by means of push notification on the SnapnSave App or the web or mobi sites, electronic mail to Your e-mail address listed in Your account information or sms to Your cell number listed in Your account information.
In the event You wish to opt-out of SnapnSave communication email firstname.lastname@example.org or change Your communication preferences in Your account on the SnapnSave Platforms.
